Terms & Conditions
These Terms and Conditions (“Terms”) govern the purchase and use of services from Motion Squad AI, a brand operated by Fog Coast Productions LLC. By placing an order through our website, you agree to the following terms.
1. Choosing Your Video
When purchasing, you’ll select one of the following video types:
- AI Video: Generated fully with AI tools. Results are fast and cost-efficient, but may not be 100% unique.
- Hybrid Video: A blend of AI-generated clips and your provided assets (footage, graphics, logos).
- Custom Video: Built entirely from assets you provide, edited and produced by our team.
By submitting any footage, graphics, logos, or other media, you confirm that you own the rights to use them or have obtained proper permission. You agree to indemnify Motion Squad AI against any claims if submitted content infringes on third-party rights.
2. Add-Ons & Extras
At checkout, you may select additional services such as:
- Rush Delivery
- Social Media Packages
- Extra Revision Rounds
Add-ons are billed in full at checkout and are non-refundable once production begins. Rush delivery will prioritize your project, but delays caused by late client responses or technical issues may still impact timing.
3. Payment
- All projects are paid in full upfront at the time of order.
- Once a project is approved for production, fees are non-refundable, except as outlined in the cancellation policy.
Cancellation Policy:
- If canceled before delivery of the first draft, we will retain 25% of the project cost.
- If canceled after the first draft is delivered, we may refund up to 50% of the project cost, at our discretion.
- If the final version has been delivered, we may retain 100% of the project cost. Refunds at this stage are case-by-case.
- If we determine before production begins that a project does not align with our services, we will issue a full refund.
4. Questionnaire & Project Kickoff
After checkout, you will receive a customer questionnaire.
- Production begins once you complete and submit the questionnaire.
- Delivery timelines are based on when we receive your completed questionnaire.
- Delays in completing the questionnaire may result in adjusted delivery times.
- You are responsible for providing accurate and complete information.
5. Delivery & Revisions
- Estimated delivery timelines will be provided when production begins. While we aim to meet them, delays may occur due to factors outside our control.
- Each project includes 2 rounds of revisions.
- Additional revisions can be purchased at checkout or later in the process.
- Revisions must fall within the agreed project scope. Major creative changes may require a new order.
6. Ownership & Portfolio Use
- Once full payment is received and the final video is delivered, you receive full ownership rights to the finished video.
- Motion Squad AI retains the right to use completed projects for our portfolio, website, and promotional purposes, unless you request otherwise in writing before final delivery.
7. AI-Specific Disclaimer
- AI-generated elements are delivered “as is”.
- We cannot guarantee that AI outputs will be entirely unique or free from resemblance to other works.
- We do not warrant that AI-generated content will be free from third-party claims of similarity, infringement, or intellectual property disputes.
8. Confidentiality & Data Handling
We respect your privacy and will not share confidential project details. However, some assets may be processed through third-party AI platforms. We will not upload sensitive or confidential information without your consent.
9. Termination by Motion Squad AI
We reserve the right to decline or cancel projects before production begins if we determine they do not align with our services. In such cases, you will receive a full refund.
10. Limitation of Liability
To the fullest extent permitted by law, Motion Squad AI and Fog Coast Productions LLC are not liable for indirect, incidental, or consequential damages arising from use of our services. Our liability for any claim is limited to the amount paid for the specific project.
11. Governing Law
These Terms are governed by the laws of the State of California.
12. Agreement
By placing an order on our website, you confirm that you have read, understood, and agreed to these Terms and Conditions.
